Apply for Contractual Adjudication

Before proceeding, the parties must agree to adjudicate using the BDT Adjudication Rules. This can be done in one of two ways:

  • parties to an existing dispute, whether or not there is an adjudication clause in any underlying contract, may agree to refer that dispute to Adjudication under the BDT Adjudication Rules by signing the BDT adjudication agreement.

or

  • there may be a clause in the underlying contract stating that the parties have agreed to adjudicate.

NOTE: if a party relies on the adjudication clause in the underlying contract, they must serve a Notice of Adjudication on the other party or parties to the dispute before applying for adjudication. This is not required where the parties have signed the BDT adjudication agreement.
