Apply for CCA Adjudication

First serve a Notice of Adjudication on the other party or parties to the dispute – these will be the other parties to the construction contract under which the dispute has arisen. If:

• the owner of the construction site is not a party to the construction contract, and
• you wish to seek a determination of that owner’s liability under section 30(a) and/or
• you wish to seek approval for the issue of a charging order over the site under section 30(b),

you must also serve the Notice of Adjudication on the owner of the construction site.

Apply to the Building Disputes Tribunal

You must apply to BDT within two to five working days after the notice of adjudication is served. For example (unless there is a statutory holiday):

• If you serve the notice on Monday, you must apply on Wednesday, Thursday or Friday that week or Monday of the following week.
• If you serve the notice on Friday, you must apply on Tuesday, Wednesday, Thursday or Friday of the following week.

If you apply too early, you will need to resubmit the application within the above period. If you apply too late, you will need to start the process again and serve a new notice of adjudication on the other parties.
